BECAGUIMEC TRAIL ASSOCIATION TERMS OF USE
PLEASE READ CAREFULLY

LIABILITY RELEASE AGREEMENT

By using this trail network, commonly known as "Becaguimec Trails", you  are hereby agreeing to the following release of liability and notice of  indemnity:

I am aware and understand that CYCLING/HIKING  CONTAINS INHERENT AND OTHER ELEMENTS OF RISK that involve the  POSSIBILITY OF PERSONAL INJURY OR DEATH and that INJURIES ARE A COMMON  AND ORDINARY OCCURRENCE in these sports. Where "I" is used in this  agreement, I acknowledge and agree that this should be interpreted to  mean myself, my heirs, executors, administrators, and next of kin).

I FREELY, VOLUNTARILY AND FULLY ACCEPT THESE RISKS, and all others  arising from the use of the Becaguimec Trails, even if arising from the  negligence, gross negligence, or negligent rescue by those associated in any way with Becaguimec Trail Association, the Town of Hartland and/or  their respective officers, directors, employees, agents, subcontractors, suppliers, servants, volunteers, and representatives (elected or  otherwise) (the "Releasees").

I understand that all  applicable rules for trail use must be followed and that SOLE  RESPONSIBILITY FOR MY PERSONAL SAFETY REMAINS WITH ME, including my  physical and emotional preparation and fitness, and I have made no  misrepresentations regarding the foregoing.

I give a FULL  RELEASE AND WAIVER OF LEGAL LIABILITY AND ALL CLAIMS that I have or may  have in the future, against Becaguimec Trail Association, the Town of  Hartland, and all other Releasees from all liability for any loss,  damage, injury or expense that I may suffer as a result of my presence  at, and use of, the Becaguimec Trails, due to any cause whatsoever,  including the forms of negligence set forth in Section 2 above or from  any breach of warranty or contract or statutory duty or other duty of  care, including any duty of care owed under the relevant Occupier's  Liability Act or other legal theory, on the part of the Releasees.  Where applicable, my undersigned parent gives a FULL RELEASE AND WAIVER  OF LEGAL LIABILITY AND ALL CLAIMS as set out in this Section 5 on my  behalf.

I AGREE NOT TO SUE and I further agree TO INDEMNIFY  AND SAVE HARMLESS the Releasees from all expenses, fees, liability or  damage award or cost of any type whatsoever arising from my  participation in these events or programs, including damages, injury or  death that may be suffered by another person.

I understand  the Releasees MAY PUBLISH MY PHOTOGRAPH OR IMAGE IN PROMOTIONAL MATERIAL (such as brochures, social media, videos & websites), without any  further consent therefore and without any compensation. I waive any  rights to notice or approval of any photographs or publications and  agree to save and hold harmless the Releasees, their officers,  directors, agents, representatives (elected or otherwise), and their  licensees and assigns from any claim or liability in connection with the use of photographs and publications, as aforesaid, or by virtue of any  altercation, processing or use thereof in composite form, whether  intentional or otherwise.

I understand that my use of the  Becaguimec Trails constitutes acceptance of this liability release agreement and that I AM  WAIVING SUBSTANTIAL LEGAL RIGHTS (on my behalf and on behalf of my  heirs, executors, administrators, and next of kin), including the giving up of my right to sue.

I HAVE READ AND UNDERSTOOD, AND AGREE TO, THE LIABILITY RELEASE AGREEMENT ABOVE.
